Terms & Conditions
1. The “Sunfeast Glucose Doraemon Contest” (“the Contest”) is organized by ITC Limited (“ITC”) purely for promotional purposes.
2. Consumers participating or seeking to participate in the Contest shall individually be referred to as “Participant” and collectively as “Participants”.
3. Participation in this Contest is purely voluntary. By participating in this Contest, each Participant is deemed to have accepted the complete terms and conditions of this Contest available on www.sunfeastworld.com/contest (“Contest Website”) as well as the decisions of ITC, which are final and binding in all matters related to the Contest. Successfully entering the Contest and winning a prize is subject to all requirements set forth herein.
4. Employees of ITC its associate and/or subsidiary companies, its advertising agencies, its auditors, and their family members, are not permitted to participate in this Contest.
5. ITC reserves right to terminate, modify or extend this Contest, at its absolute discretion, without assigning any reason whatsoever including extending, withdrawing, or discontinuing the same without notice, at its sole and absolute discretion and without any liability. All decisions of ITC in respect of the Contest and the prizes therein will be final and binding. The terms & conditions as mentioned herein shall govern the contest and shall prevail over any communication/ representation which results in a conflict of any nature whatsoever.
6. The Contest is subject to all applicable central, state and local laws and regulations.
7. ITC reserves the right to exclude any person from the Contest on grounds of misconduct or criminal record.
Eligibility
8. Only Indian residents are eligible to participate in this Contest.
9. In order to be eligible for the Prize, all Participants will be required to have valid address proof, government issued photo identity proof such as PAN Card/ Driver’s license/Voter ID/valid passport etc, or parent’s or legal guardians consent, if applicable a copy of which will have to be submitted if the Participant is shortlisted without which the Participant will be disqualified from the contest.
Contest Details
10. The Contest is valid from 1st Jan 2019 12 A.M. to 31st May 2020 (hereinafter “Contest Period”). (Inclusive of both days). A Day for the requirements of the Contest Period is 12 AM to 11.59 PM of a particular day.
11. Entries received before the commencement of the Contest Period will be considered in 15th July 2017 12 A.M. to 31st May 2020 Day slot.
12. The Participants can submit entries at any time during the Contest Period but the Prize selection of 1 Winner of the Contest Period will be considered based on the entries received the previous Day.
13. Time of participation shall be the time at which an entry from a Participant is received through the website portal at the link specified herein (www.sunfeastworld.com/contest).
14. The Contest shall run on the Sunfeast Glucose Rs5, Rs10 and Rs20 packs pack of ‘Sunfeast Glucose Doraemon Contest’ (“Promotional Pack”).
Prize Details
15. One winner (1) will be chosen each day between midnight of previous day to midnight of current day (12am to 11.59pm) during the Contest Period.
16. The daily winners shall be chosen by judges appointed by the ITC Sunfeast Glucose Brand Team based on creativity in the answer. The decision of the judges shall be final and binding upon all Participants.
17. The Prize cannot be transferred, exchanged or redeemed for cash.
18. The image of the Prize depicted on the press ads/posters/TVC's etc. are for illustrative purposes only and the actual Prize may vary from the depiction made.
19. ITC or its Agencies shall not be liable for any loss or damage of the Prize due to Act of God, Governmental action and other Force Majeure circumstances and shall not be liable to pay any compensation whatsoever for such losses.
How to Participate
20. A Participant can enter the Contest any number of times per day from a mobile number through the link specified herein.
21. To participate in the Contest:
i. Participants are required to write an answer to the question asked on the landing page. Then submit the same with their mobile number and name.
ii. After sending the entry in the valid format, Participants will get a thank you dialogue on the same page.
22. ITC shall not be responsible for (including but not limited to):
I. Any SPAM generated messages
II. The Operator Code not being displayed on the Participant’s mobile phones
III. Any lost, late or misdirected computer transmission or network, electronic failures or any kind of any failure to receive entries owing to transmission failures or due to any technical reason
IV. If the Participant has registered himself to the DND of the telecom provider/ the Participant has registered with National Do Not Call Registry/ Participant has specifically requested for not receiving messages for the specific campaign
Contacting Winners
23. Once the Participant is shortlisted as the winner for a particular day, ITC or an organizer appointed by ITC shall contact each shortlisted Participant by a phone call to the number from which the answer entry was received. The shortlisted Participants will be contacted within four weeks from the time of winner selection.
24. In the event the shortlisted Participant’s number is busy, unreachable, or he/she does not attend the call, two (2) more attempts will be made to reach the Participant on that day and/or the next day. If even on the third attempt, the Participant does not attend the call, or is unreachable, the Participant’s participation in the Contest comes to an end and the Participant’s entry stands cancelled and Participant becomes ineligible to receive the Prize. In such an event, another Participant will be shortlisted by ITC Ltd.
25. The shortlisted Participant will have to provide a copy of his address proof or personal identification, copy of his/her PAN Card or his/her family members’ PAN Card in case the winner does not possess a Pan Card of their own.
26. No Prize will be awarded if the information provided by the Participant at the time of entering the Contest is not factually correct. The Prize will be handed over to the winner only after the above-mentioned formalities are fulfilled.
27. The list of winners shall be published on
www.sunfeastworld.com/contest within 120 days of winner selection.
Courier Requirements
28. The Prizes will be dispatched to the winners via courier, whilst carrying the Prize for the winner; the courier will carry an acknowledgement receipt (POD).
29. The courier shall require the shortlisted Participant to sign the acknowledgement receipt (POD) as a proof of receipt of the Prize, without which the Prize will not be handed over to the winner.
30. The courier shall collect the signed POD, a self-attested Photo ID from the Prize winner.
31. If the Prize winner or the family member of such Prize winner present at the address does not cooperate as per the requirements mentioned herein with the courier, the Prize will not be given to the shortlisted Participant and the Prize will stand forfeited.
32. The Prize will be given to the authorized family member of the winner on submission of the documents mentioned in clause 32 along with a proof of letter of authorization from the winner in favor of the family member (in the event the winner is not available at the designated address).
33. If the winner is not available at the given address, the courier will make 2 more attempts to collect the documents and deliver the Prize. If still unsuccessful, the courier shall make no further attempts to deliver the Prize. In such an event, the winner will be informed of the place from where the Prize is to be picked up at their own expense. If the Participant fails to pick up the Prize from the designated place within a week of informing him / her, the Prize will not be given to such Participant and the Prize will stand forfeited.
34. If the address is unserviceable, then the shortlisted Participant will be required to travel to the nearest courier hub at their expense to collect the Prize.
35. ITC shall not be liable for non-receipt of the Prize due to incorrect details provided by the winner.
Publicity
36. The Participant undertakes and irrevocably and unconditionally permits ITC to cover the Contest through various media including newspapers, radio television news channels, internet, point of sale materials, etc., and shall not raise any objection, protest or demur to such coverage or in this regard.
37. At the request of ITC, Participants shall participate in all activities relating to the Contest surrounding the winning of the Prize, free of charge including participating in any photography/videography session, interviews etc., and they consent to ITC using their name and image in promotional material.
Intellectual Property
38. All right, title and interest, including but not limited to the Intellectual Property Rights, in the promotional material(s) and in any and all responses received shall vest solely and exclusively with ITC at all times. ITC or any person or entity permitted by ITC in this regard shall be entitled to use the responses received or any information in connection with the Entry in any media for future promotional, marketing, publicity and any other purpose, without any permission and or payment to the Participant.
39. All material submitted in connection with the Contest (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to ITC upon submission and become the property of ITC exclusively. ITC may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of ITC.
Terms & Conditions for the Prize
40. The Prize winner shall follow the instructions given by or on behalf of the Organizer, when a call is made to him/her by or on behalf of the Organizer informing him/her in the event of his/her selection as the Prize Winner.
41. Award of Prize is subject to the verification of documents such as (government Photo-ID proof such as valid Indian passport /residence proof/ Driver’s license PAN card and/or such other documents as may be requested and submitted by the Prize Winner. After verification the Prize Winner will be informed about the entire process of redemption of the Prize.
General Conditions
42. Each Participant represents and warrants that he/she is legally competent to enter into binding contracts under applicable laws. Participants below the age of 18 shall participate with the consent of their parents or legal guardians. By taking part and/or entering into the Contest the Participant warrants that all information provided by Participant regarding Participant's name, age, state, city, address, phone number, etc., is true, correct, accurate and complete.
43. The decision of ITC or the Agency, as regards the selection of winners and distribution of the Prizes shall be final, subject only to ITC’s approval. No correspondence or any other claims whatsoever, in this regard will be entertained.
44. ITC reserves the right to change, defer, alter or cancel this Contest in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Any decision of ITC in this regard and in general with respect to this Contest and the terms and conditions thereto shall be final, binding and non-contestable.
45. The decision of ITC shall be final in all regards and no communication shall be entertained in this regard. None of the provisions of these Terms and Conditions shall be deemed to constitute a partnership or agency between any Participant and ITC and the Participant shall not have the authority to bind ITC in any manner whatsoever.
46. Neither ITC nor its agency shall be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Contest due to any government restrictions.
47. Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of ITC or its Agency.
48. ITC or its agency accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, loss of SMS, loss of internet connectivity, unique codes, documents, demand drafts, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. ITC or it’s agency shall not be liable for any consequences of user error including (without limitation) costs incurred.
Release and Limitations of Liability
49. ITC Ltd. shall under no circumstances be liable, whether jointly or severally, for any loss or damage suffered or sustained (including but not limited to consequential loss), including for personal injury or property damage suffered or sustained or any costs incurred, as a result of acceptance of any Prize.
50. By entering the Contest, the Participant hereby releases from and agrees to indemnify ITC and/ or any of its respective officers/employees from and against all liability, cost, loss or expense arising out of acceptance of the Prize or participation in the Contest including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise.
51. ITC accepts no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself, or third parties in relation to the Prizes.
Disputes
52. The courts of competent jurisdiction at Bengaluru shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with the Contest.
53. Further all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Participants and/or ITC and/or Partners of this Contest, shall be governed and construed in accordance with the laws of India.
